Hello,

Can anyone offer advice please?

25 weeks pregnant and starting maternity leave in 3 weeks, currently employed by BHS and have been given notice of impending redundancy.

I currently earn above the SMP wage so am eligible for this.

I have read I should be offered a job elsewhere in the company, does this mean if there were any remains of BHS that I should be given another role?

Thanks in advance

Do you mean 35 weeks as opposed to 25?

I am fairly sure you're not automatically entitled to a job elsewhere in the organisation. It depends on what roles your capable of filling and what vacancies the organisation has.

In any case BHS is closing down so I'd be surprised if they had ANY vacancies at all.

Pregnancy does not prohibit you being made redundant.

In the case of something like BHS , where the people not in the pool are very much the minority i think you would really struggle to put an arguement across for special treatment ...

discrimination protections would only apply if you had a situation where it was clear the selection criteria to put people into an at risk pool looked to a reasonable person as though they were discriminatory ...
