A quick TUPE question.

I wasn't sure where to put this, here of SP&L but am only after a qualified opinion or two.

In my scenario, company A provides a service, this is completely contracted-out and performed by company B.
Company B gets liquidated, and company A brings it back in house.

Would I be right in assuming TUPE would likely apply here?
It seems to meet the SPC tests to my laypersons eyes.

I'll be paying for legal advice when company C makes an appearance on the scene in the near future.

Depends on how the purchase of the liquidated company is treated. And if they are leaving it whole and just changing the name on the wrapper and leaving it as a separate legal entity.

I think the two year rule would apply....? As in, could just be let go if employed less than two years.

Thanks chaps - it's progressed faster than expected so will just leave it to the lawyers to advise as a matter of urgence.
