Hi all

Wonder if anyone can help with advice.

My wife has been overpaid after the birth of our 2nd child (since 2020) by 3 hours a week. Now, her payslips don't have hours on, and she's not that hot on how a NI and tax threshold increases affect things so she'd assumed that it was right given changes over the years.

Her company looking back don't appear to have any paperwork relating to her pregnancies, and are relying on dates she gave. We've asked for documentation, payslips, a monthly breakdown that includes holidays, sick, parental leave, unpaid days etc to see how they've come to the amount.

If they don't have the documents, is there a case to fight this? It's a big chunk out of the families budget given we've got 3 children and she only takes 1k a month, to pay 260 of it for 2 years.

And if she left, I presume they'd persue the repayment anyway...

They need to provide some evidence of the calculations.

As you say, when it’s 3hrs/week the net amount can easily get lost in the changes to NI and various thresholds, so not something you’d necessarily spot.

Equally, if they provide the evidence and it’s clear, you should pay it back.

A reasonable employer would allow it to be done over a reasonable period of time, if that’s what you want.
