Feel very sorry for OP.
I've had similar experience.
What I learnt.

1. Don't buy a new car. If you buy S/H 1 year old demo then disposal or px for another is worth the loss. If new the loss is to large.
Or
2. Immediately on such major problem refuse to keep the vehicle stating you've lost total confidence in it leave it at the dealers and peruse refund from leasing company etc.. Ie refuse to have it back under and condition.
Or
3. Write it off and claim the insurance.

The nice long route is soul destroying and I'd happily pay several thousand never to go that route ever again life is too short!
New car Never again!

Option 1. Is currently my preferred route I used it on a Mercedes with a/c issues it cost me £3,000 to swap after 6 months ownership with the same dealer after their attempts to fix it made zero difference.
Give the problem back every time....

Mercedes are far worst than BMW in my experience though in the uk without a Lemmon law we're pretty much fked with new cars.
Interesting. Option 3 - deliberately writing a car off to claim the insurance, would appear to be somewhat, well...erm, how you say.... fraudulent, illegal. redcard

True scrap 3.
1+2.
Best to just dump it back at the dealer or PX it.

Good on you!

It gets my goat when geezers don't drive these great cars.....life's way too short chaps.....you'll be back in nappies before you know it....if you're lucky.....so get that F10 out, fill up with V-power.....and have some fun!!

The M5 is on my short-list along with RS6 and CLS, I won't be confirming an order until early 2014 and if this story doesn't have a happy ending the M5 will be off the list, I simply won't take the risk, especially as a recent LC1 owner appears to be suffering a similar problem.

My 2012 M5 had a turbo issue and it sat for 70days at BMW waiting for parts to fix it, only for it have more engine problems 2 weeks after getting it back at which point I contacted the company I brought the car from and said enough is enough and they have brought it back off me at the full purchase price. BMW treat there customers like dirt in my opinion and they will do nothing unless you spend half your life chasing and shouting at them, They sell themselves as the ultimate driving machine but there seems to be so many serious issues arising across the range and nearly every customer I've heard that's had a problem are disgusted with the way they are treated, Its either we carnt find any fault sir and shoved out the door or as im my case no one from BMW can be bothered to call you to keep you informed and when dates were given they failed to deliver 4 times. My sympathy goes to the OP as we all buy cars like the M5 because we love cars and not just to go from A to B!!!!!!
