Umm, no. Like footpaths, bridleways and all other RoWs, they're unadopted - the council are under no obligation to maintain them at all. The landowner does have an obligation to maintain them, though.
Some RoW are adopted. Some, not all. The way I read what you've put is that unsurfaced RoW are unadopted by default and that just isn't the case.

OK, there may be a very tiny fraction of RoWs which are adopted - mostly, probably, because they're actually across council-owned land.Crossflow said:

I never mentioned surface.One problem we have here (on the other side of the world ) is that a small percentage of 4x4 drivers will deliberately churn through boggy patches with diffs locked and mud tyres spinning, turning the road into a boghole and damaging it to no purpose.
Said bogholes are then almost impassible by "normal" 4wds ie those without diff locks and 33" mud tyres.
This has caused the closure of several roads over winter, as the council gets sick of the cost of repairing the damage.
It pisses me off, as I have a 4wd and enjoy pottering along fire trails etc., and most of us can somehow manage to do so without destroying the trail and ruining it for everyone else
