How do you know that on a daily basis,there aren't incidents of discretion and indeed common sense being shown?Also,if you agree that it wouldn't be in the public interest to prosecute,what would be the purpose of reporting her?.Assuming that you don't mean reporting her to the DVLA medical unit as she already has a revoked licence,what do you think reporting her,eventually leads to?

Had it been solely down to me I would have frown and believe me I did keep offering my opinion. For the sake of family harmony I let it slide but was very close to taking matters into my own hands.

It was with her two daughters to resolve (my wifebeast and her younger sister). Specifically younger sister was going to take the car away and store it on her farm. Kept not happening/being too busy. I also think they were both put off by the expectation of aggression than comes with Alzheimer's/Dementia. On the day they took it it took them 6 hours to calm her down sufficiently to drive away.

Cancel your car insurance and go out for a drive, you'll find out how much discretion you'll get, and I can guarantee you it will be zero!

They will also charge you for moving your car for you!

As I have said, my real beef is with the police!

Yup, cancel and get done, no problem. You know that is breaking the law.

If you are senile, you don't necessarily remember the cancellation or the requirement for insurance. Frequently you don't remember where you live or your name, partner or kids.

The mentally ill already have a tough enough time, as do the police coping with the fall out. The coppers here acted decently, removed the hazard quickly and effectively while behaving like decent human beings.

What do you think prosecuting the old dear would achieve? Deterrent? Punishment? Rehabilitation? Or just spite?

At least on this occasion, nobody was injured in a crash, its just a shame her family ( though she might not have any for all I know) didn't keep the keys well away from her until the car could be sold.
I was impressed that she did indicate left just before she was finally stopped!

So, you could blow say 70 at the roadside, by the time you get to an evidential machine you could blow 50, then you are offered a choice of blood or urine tests before you can be prosecuted. Did I hear that right?

I believe so.

I suspect the fact that the Police are so short staffed also means that when you get into custody the waiting time also means levels can drop.

In my area it could take you 20 - 30 minutes to even get to the nearest Police station.

So whoever comes up with an evidential breath test will be quids in I suspect.

It's mandatory reporting! I still believe she should have been reported, the police don't enforce the law, they don't get to make it!

For all they knew at the time, she may have driven again!

If Police don't have the ability to use common sense when applying the Law, then there can be no discretion - ever - for any offence, no matter the circumstances. Everyone who gets stopped gets prosecuted. Is that the utopia you're seeking?
