1) the defence only gets a copy of the interview when a decision has been made to prosecute - so the defence solicitor will take notes to assist with any further interviews that may happen later (or to make up a story!)

I believe a solicitor can be excluded for certain reasons but the Police may be on dodgy ground if they try to interfere with the right to consult a solicitor.

I suspect a solicitor wouldn't do it as they could be reported to their regulatory body.

Maybe a Police officer knows the definite answer to this.

3) Difficult one to answer without knowing everything.
I spose the phone was a critical part of that so he wanted to say just say the mimimum to try and dissaociate himself from it.

Pace states give tape at charging decision. But most police will give it straight away if asked. And there is nothing to stop a solicitor recording it using a dictaphone anyway. As many do.

The notes are just more concise.
