I don't think it makes much difference, the prosecution is still required to prove beyond reasonable doubt she committed the crime without coercion from her husband; which requires him to be present and her to have no choice in the matter. I think the prosecution has proved she had a choice, but we'll find out soon enough.
When the first trial took place, the newspapers reported that the prosecution needed to prove "beyond reasonable doubt" that she had not been subjected to marital coercion. However, I seem to remember that the judge's summing up said that defence had to prove "on the balance of probabilities" that she was coerced.

The Telegraph has revealed that Huhne made most of his money from speed cameras. rofl

They took him to Court, they declared battle and came up against strong resistance, he didn't roll over quite as readily as they hoped, good for him, it is only when the really very stupid realise that a law is being misused at great expense to their pay-packet deductions do the flock of sheep come to their senses and (hopefully) call a halt to overweening judicial profligacy.

They should on principal alone lose any opportunity for clawing back a penny and should face the full contempt of the tax payer who funds this bit of vanity prosecution.

That wretch'ed Starmer chap needs a proper kick up the pants for his vile and grossly exaggerated attempt to elevate the majesty of the law.

Earlier in the thread you seemed to be awfully upset by the fact that the taxpayer was paying to bring this liar to justice.

Surely, you must be pleased that Huhne will bear the cost.

If you are not pleased by the fact that the taxpayer may be spared some of the costs, then your position would appear to be a bit hypoticral.
