I don't think it makes much difference, the prosecution is still required to prove beyond reasonable doubt she committed the crime without coercion from her husband; which requires him to be present and her to have no choice in the matter. I think the prosecution has proved she had a choice, but we'll find out soon enough.

Cart before the horse old boy!They took him to Court, they declared battle and came up against strong resistance, he didn't roll over quite as readily as they hoped, good for him, it is only when the really very stupid realise that a law is being misused at great expense to their pay-packet deductions do the flock of sheep come to their senses and (hopefully) call a halt to overweening judicial profligacy.
They should on principal alone lose any opportunity for clawing back a penny and should face the full contempt of the tax payer who funds this bit of vanity prosecution.
