Just to be clear, if this was a 16 year old having consenual sex with a 14 year old would it be charged like this?

The crime is the same for anyone under the age of 18 as it is for anyone over 18, though the sentencing guidelines are different.

It's irrelevant though, this is an accusation of sexual assault.

Thanks, I just wanted to be clear. Had it been essentially a 16 year old sleeping with a 14 year old then while it would be illegal I wouldn't exactly be bothered, it's the kind of thing teenagers do.

But presumably from you repeating the sexual assault claim this is basically a rape, right?

Sorry for not being au fait with what the legal terms for sexual offences are and what they mean, but they are not exactly things I keep track of!

Just to be clear, in the eyes of the law there is no such thing as consensual sex with a 14 year old.

His character has been in prison for a few months now. Easy to write him out without needing to bring him back in my my wife's opinion.

A 16year old having sex with a 14 year old counts as sex with a minor does it not? Not sexual assault.

No such thing as 'statutory' rape in England - you only hear that on 'CSI'.

The Savile thread explains things, but from what I read:

Sex with someone under 16 by someone over 18 is illegal (but not rape, unless defined as such)
If they are under 13, it's rape.
If they are between 16 and 18, and the other person is in a position of trust/care, it's illegal.
Sex between, say two 15 year olds is technically illegal, but not in the public interest to prosecute, unless one party was coerced. Rape would be a separate issue in this case, subject to the same definitions as between two adults.
