Yeah from that article Steffan - they are appealing on the question of law, as we were discussing at the time.

Interesting article indeed. I certainly think that with all the nonsense Pistorius displayed in the trial playing to the gallery and therefore underlining his primary concern of getting off, not shouldering the responsibility of murdering his fiance whenever possible and showing an absolute refusal to face the consequences of his actions, the verdict is weak and the sentence weakler. I do hope this is bettered in the appeal. It seems to me that a short (possibly very short) sentence for the appalling acts by Pistorius against a defenceless woman that literally blasted her to pieces in her own home is just wholly inadequate and ought to be significantly increased. Ten years would seem much more appropriate to me. Is anyone here well versed in South African criminal procedure?
- Is leave to appeal required for the appeal against sentence and or conviction?
- If the appeal against conviction is successful then can the appellate court substitute another verdict, or must it order a retrial? Would the double jeopardy doctrine not apply in the circumstances of this case?
