And now the regular, career criminals will know that he's not armed and an attack on him or his property will not be met with a few bullets. I wonder if that's a justice the PH mob would prefer.
Whats your point?

He murdered an innocent woman and all you care about is that he wont be able to defend himself against armed intruders. If thats the price he has to pay for being trigger happy so be it. He brought it upon himself.

Should every convicted criminal in SA be allowed to own a gun or is just Oscar you want to have special treatment?

Regular, career criminals?

The ones who didn't shoot their girlfriend dead through a locked door, you mean? Perhaps they should have just let him go; after all, he's not a regular, career criminal, is he? Just a bit handy with a weapon when there's a defenceless person (not) threatening him.
silly

I *think* it would be called karma.

I'm not suggesting he should be, however, he wasn't convicted of murder and the attitude here is very much that he was.

Living on a posh housing estate in SA is a bit like being in prison anyway - high walls, tight security, armed guards etc.
You know, I thought that until I Iived in one; it was more like living in a Hollywood film about idyllic America. Therefore about 8-10 streets arranged around a central park. Kids playing in the streets, bbq's on the communal park with the whole neighbourhood there, doors unlocked....it was really nice.

You did however, come through armed guards at the entrance and yes, the complex was surrounded by 20 foot walls plus razor wire. Honestly though, within about a day I'd forgotten all about the guards etc as it was just such a nice community.

And if (or when) that happens, I'll support the court's decision and accept that he can then be called a murderer.

Hopefully they are just fking with his head by letting him out for a bit before dragging him back through the courts and off to a proper sentence.

It's a bit like the OJ Simpson case. OJ viciously beat his wife multiple times but... surprise surprise ... wasn't convicted of her murder. Guilty of 'wrongful death' by a civil jury though and fined £35m.

Pistorius is, in the minds of many, a conceited little f*ck who got away with murder.

South African prosecutors have started an appeal hearing on whether athlete Oscar Pistorius should be convicted of murder instead of culpable homicide. Clicky

I was not very impressed by either of the advocates at the trial, or by the trial Judge. Watching the live feed from the Supreme Court, I am impressed by Justice Leach, but still not very impressed by Barry Roux for Mr P.

As you can see, conducting an appeal in a common law court is not about making a pretty speech. It's more like a really tough exam viva voce.

Roux strikes me as being under prepared. He does not have his statutory and case law references at his fingertips. He sometimes gets a bit flustered. Justice Majiedt seems to be on the ball.

Nel is better. He speaks more slowly, and gives more direct answers to the questions posed by the Judges. He also very sensibly elected not to reply to Roux's submissions, no doubt judging that he did not need to. I note from the court clobber that Roux is a silk and Roux is a junior, but that just goes to show that a silk gown is no guarantee of being the better advocate.

Seems Roux is aware of his shortcomings hehe

The South African news site News24 said the exchange happened after the court adjourned when microphones in place for broadcasters recorded Roux telling the state prosecutor, Gerrie Nel, in Afrikaans: “But that I am going to lose is a fact.”

More the shortcomings of the Trial Judge, really, as it looks to me that she rather cocked up the legal analysis of the facts.

Full hearing viewable via link below. Roux was better earlier on, but didn't deal so well with judicial questions later in his submissions.

I'd agree with that.

I watched this, and some good portions of the trial.

Nel is certainly the better orator. I could see the point that Roux was making (eventually) but it took him about 6 or 7 goes at answering pretty much the same question for the bench to put it in an understandable way.

Interestingly, in summing up at trial Nel went over in great detail the legal point that is now the crux of this appeal.

A bump because in listening to the live appeal it sounds like that he's going to prison....

ETA: Guilty of murder.
