Wow. Amazing - and finally, in my view, the right result.

FError in law we'd been discussing. Good job SA Justice System - eventually.
Eta
But how could the trial judge make such a fundamental error?
...and does OP have a right of further appeal?

Seems timely to repost this link. It's a reminder of the error in law from #judgemasipa

I'd lost track of what was going on. Guess he won't be running competitively for a while.

From the BBC link http://www.bbc.co.uk/news/live/world-africa-349890...

BBC said:
Murder sentence: 15 years minimum

So Judge Lorimer Leach at the Supreme Court of Appeal in Bloemfontein has said that in the interest of justice, the manslaughter conviction of Oscar Pistorius for killing his girlfriend Reeva Steenkamp must be set aside and replaced with the correct conviction - murder.

Under South African law, murder has a minimum sentence of 15 years.

However, experts say that a judge can exercise discretion if there are compelling reasons to do so.

Pistorius is currently under house arrest, staying at his uncle's home in Pretoria.

He was transferred there in October after serving one year of his five-year sentence for manslaughter, also known as culpable homicide.

He is likely to be re-sentenced in the New Year by his original trial judge Thokozile Masipa.

guess sometimes justice does prevail.

I still don't understand how the judge came to the manslaughter decision in the first place and she needs to be sanctioned IMO , if you shoot a gun at someone then you mean to kill them

More the shortcomings of the Trial Judge, really, as it looks to me that she rather cocked up the legal analysis of the facts.

Full hearing viewable via link below. Roux was better earlier on, but didn't deal so well with judicial questions later in his submissions.

Finally. Now they need to sentence him appropriately. I see no justification for any leniency.

Minimum sentence for this type of murder is 15 years. It's a strange world we live in where we have "degrees" of murder, dead is dead but I'd be happy with that length of sentence.

There are very different type of killing though - e.g. Hannibal Lector vs an engineer incorrectly tightening a critical bolt on an airplane.

The ultimate outcome is the same, the degree of immorality wildly different.

Hopefully it will be a proper prison as well. Remember seeing a documentary on SA prisons where they interviewed one of the gang leaders, and he talked about how he would make new inmates his girlfriend. When asked what he'd do if they refused, he just replied "I kill them". One look at his eyes and you could tell he wasn't joking
