Is the "lazy, Irish, " thing a slur or statement of fact? It's not racist to call someone Irish if they are Irish.

Is the "lazy, Irish, " thing a slur or statement of fact? It's not racist to call someone Irish if they are Irish.
Take out the word "Irish" and what's left may be an arguable fact. But include "Irish" as Clakson allegedly did, then it's racist.

Why are some posters confused by this?

I'm fairly confident ice used such language in the heat of the moment in he past - didn't result in being sued (though I didn't punch him smile for being said lazy c@@t)

TBF to Tymon, I guess that whilst he did not initially want to press charges, in the amongst the fallout, it which would appear to have cost his job, in amongst the demise of Top Gear and all the other things.

To be clear, whatever he did or did not do, there were no grounds to assault him and, given the assault, the (very mildly) racist language used by Clarkson could in no means be easily construed as banter and does, in fact, infringe laws. So there is a case, and I'd be surprised if it were rigorously defended by Clarkson's brief, other than to mitigate the inevitable damages.

The term racial discrimination is an (inaccurate) portmanteau or shorthand term. Discrimination on grounds of ethnic or national origin is (usually) unlawful, and harassment on such grounds is always unlawful. In context, calling someone a lazy Irish could be as bad as calling someone a lazy black or a lazy Jewish or whatever. All depends on the context.

My guess is he could not fit in another job at the BBC, so has left and launched this action, probably to be followed by a constructive dismisal claim....

My bet is the context is so clear on this one they've already been in negotiations but the fool has asked for too much money. I imagine the negotiations began at the time the fellow said he wouldn't press charges. Clarkson has now decided his ongoing career is secure so he's not bothered about the publicity.
