Surely if the man in question was not made aware of the minimum charge then he does not need to pay it. No contract has been entered in to or inferred, so he only needs to pay for the water at the upmarket rates. By ordering the water, he enters in to the contact to pay for that - but not the minimum spend.

He didn't. I'm a bit surprised that a man of his experience (and in the property game) just sucked it up. I wouldn't have and explained why, but perhaps offer a tip to the waiter.oyster said:

Wouldn't blame them if they did, many years ago a mate's mum & dad ran a pub next to a bus station. The customers used to take the piss. (Ok I could have phrased that better)

I'd suspect also if they'd had more than some water i.e. cheapest on the menu ( or they prob even asked for tap water) then the min fee would have been waived. Suspect also if resident at the hotel it would have been waived too. Wonder what his attitude was like ?He's a Muppet.

You're correct but in fairness to the hotel, a lot of their clientel might take offence at the idea they need to be informed that there's a minimum spend.Edited by hairyben on Saturday 9th August 16:56
