At the High Court in Livingston judge Lord Boyd noted that Bradley "was a man of violence" and had "10 convictions for assault" prior to his death.
He told Grant: "But you, of course you did not know that. What you did know was that earlier that night Patrick Bradley had robbed your son of his mobile phone at knifepoint.
"Had he been caught it seems likely given his record that he would have been prosecuted in this court, the High Court, and on conviction would have received a High Court sentence.
"As it happens you had the means to bring him to justice because the phone had been easily located by the Find My iPhone app."
The judge added: "All you needed to do was to phone the police and give them the information. However, you armed yourself with a knife and, along with your three sons, went looking for him."
Losing an eye and several years of your liberty over an iphone is silly. My sympathies lie with the jailed man - perhaps he should have left the house that day with a baseball bat instead of a knife. He told Grant: "But you, of course you did not know that. He'd probably be dead if he had.If someone stabs you in the eye, they mean business. If you stab them back and they die, well tough titty
Error of judgement to bring a knife, however it possibly saved his life.
Unfortunately as soon as the decision of "let's confront this c**t, I'll just bring a stabber too" was made the momentum built and there would be no stopping the inevitable outcome.
A case could possibly be made for a disillusionment of the police led to this event but that's probably only a minor part of the causality.
Was it murder/manslaughter? I'm not sure if I would describe his actions as such. He knew he was confronting a thug. If he did so unarmed and ended up dead would the world be a better place? I think not.
The court clearly sees as the only action a citizen should take is to call the police.
This man is not a murderer or a killer imo, just a father who decided to stick up for his kids and unfortunately went about it in the wrong manner.
Easy to say without the anger, adrenaline and the knowledge of where the mugger was...

Someone steals your phone and you know where it is. Do you:
a) fetch your three sons and grab a knife
b) call the Police
I'd choose "b" (nevermind that I don't have any kids) - from what I'm reading this is hardly a case of self defence, however much of a scrote the man who died might have been the guy who's been jailed went looking for trouble.

Clearly went there ready for it to get very nasty, very quickly.
Judge tells him he should have just called the Police with the address, but does any one have faith the Police would have done anything? Or any faith our legal system would have seen the thief punished if the Police did get involved?
No sympathy for the thief, but the bloke was wrong to appoint himself judge, jury and ultimately executioner.

Maybe if policing and law enforcement weren't so ineffectual in the UK this chap wouldn't have felt the need to take matters into his own hands.
Ten prior convictions and still up to his usual tricks, it is frankly shameful that despite many prior run ins with the police this chap was still on the streets and continuously allowed to break the law with little or no recourse.

change option 'a' to fetch your 3 sons and go after the scrote and that would be my choice.a) fetch your three sons and grab a knife

The law invariably lets lowlife off to commit again.A good kicking would be in order
Many years ago, a mate of mine was beaten up at a bus stop on Deptford High Street by a couple of blokes simply looking for trouble. He was Ok but looked a bit of a mess but, on arriving home, his dad was very shocked. Shocked, in fact, to the point of bundling his son into the var and driving back to Deptford to look for the pair.
Well, would you believe it, they spotted one and mate's dad got out of the car and approached him. Turning to to his son, he asked if this was one of the pair who had beaten him up. Upon receiving an affirmative answer, mate's dad simply took hold of the attacker by the balls - inside his trousers mind - picked him up and threw him across the street. The chap just lay slumped in the gutter, unable to move because of the pain of being picked up by the balls and launched. My mate was a bit stunned. We all knew his dad was big and a bit tasty but this really did take things to a new level.
Said attacker never aused any trouble again, at least not to our little gang. But then things were very different in the sixties.

The Big Society is going to need a bigger baseball bat.Interesting thoughts from the judge about the Find My iphone app.
Another way of looking at it may be given the robber's record he should have been in prison and not out robbing people at knifepoint and then there wouldn't have been any need for the Find My iphone app or the knives.

Would it be correct to ponder that if he hadn't taken his own knife with him, but had somehow disarmed the mugger of the mugger's knife after being stabbed and used that in self-defence, the custodial outcome would have been different?V8covin said:

I wouldn't because I'm a total pussy but also because I always have the name "Kenneth Noye" in the back of my mind when thinking about that sort of thing.
He should have contacted the Police... at least that way he'd have a crime number rather than a prison sentence.
The Judge must live in some perfectionist cloud cuckoo land if he thinks the police would have done anything effective over an Iphone.
Sympathies the to newly one-eyed fella, shame for him that the perp was such a nutter, I would have thought that 99 times out of 100 the perp would have been immediately intimidated enough to just hand the phone back... in this case it appears the perp was mental enough to stand his ground.
