The programme heard claims of police insensitivity in dealing with the families in the aftermath of the crash.

Robyn Ewing said that when her family were waiting in the city chambers for news, a policeman came in and said, 'We've just heard back from all the hospitals and we can confirm that your mum is not on the list of people who are in the hospital, therefore she must be one of the ones in the morgue.'
She said: "That is how we were told. That was pretty much the exact words. In the morgue. So it wasn't, 'Unfortunately… I'm sorry but…' It was, 'Your mum's in the morgue.'

fking hell.

Anyone else think the tt waited until the last minute deliberately so it would cost his former employer as much as possible before he resigned ?
Rather than wanting to inconvenience his employer, I think it was purely down to keeping his salary for as long as possible.
Quite possibly. Fits in with his totally selfish, irresponsible character seen all along.

For the life of me I can't see why he isn't up on multiple manslaughter charges.

Quite rightly, this miscreant gets jail for failing to inform DVLA and his employer of a medical condition that would preclude his driving.

Anyone care to suggest how this case is in anyway different to the bin lorry driver please. Scottish Law perhaps?

An absolute travesty.

Sadly, I suspect the tragic timing of this accident last year and subsequent outpouring of grief by all (including social media, main media, and indeed the thread on here) portrayed this man as a "victim" too, and this was mirrored by the investigators, who pussy footed about him, and then believed the complete shyte he finally came out with. And because he was a "victim" too, they made their decision not to prosecute him, because he was just some "poor guy who blacked out, just like that" ......instead of actually investigating him, treating him with the suspicion they should have done as a taker of multiple lives, and checking into his background PROPERLY, rather then just believing his shyte. If he had had nothing to hide, he would have been vindicated and no prosecution forthcoming.

It seems odd that within a matter of some weeks of him being given the all clear from prosecution, they started to find out he was a lying cheating scumbag...? Why not before??

Of course all this allows for a private prosecution, so prepare for the stories not of how he has disposed of and transferred his assets to other people in the last 12 months. To avoid any loss to himself.

But it is ok, the Council will pick up the compensation bill, as they rightly should, as their due diligence appears to have fked up too, in hiring this ahole.

In a perfect world he'd be so racked with guilt he'd dangle himself from the end of a rope but he looks like a selfish, self serving sociopath so hey ho.

I don't see why they can't go back on that exemption, since it all comes down to his deliberate deception in the first place?

Private prosecution being brought.

It would be nice if this materialises however private prosecutions in Scotland, well in the rest of the UK too, are as rare as hen's teeth - I believe there have only been a handful take place in Scotland in over a hundred years.

Totally agreed.

What makes him even worse is post the tragic & totally avoidable accident he has lied further on and on meaning those relatives and friends have had to suffer longer needlessly.

If that man had any decency as soon as he was awake in hospital he should have come totally clean. Yes that would have been a hugely hard confession to make to your family then the victims relatives but you'd have ended the heartache and allowed them to grieve properly instead this nasty has made them suffer for a year until the fact were dragged out.

Hopefully there is enough evidence for the police to take this further and prosecute IF not I'm sure some crowd funding for a private court case would more than cover the costs.

Doesn't the new evidence mean that the decision not to prosecute can be overturned?

But the Crown Office would then lose face having entrenched themselves too deeply!

I'd be delighted to see the decision to prosecute reversed, but it must be very unlikely. Even if permission was granted for a private prosecution, I predict this unpleasant man would mysteriously come down with all manner of mental illnesses, ailments etc, rendering him unable to stand trial.

IANAL but this stinks. Surely you look at the available evidence before jumping to a 'do not prosecute' decision, and even then when further evidence comes to light that decision should be reversed.

This guy should be rotting in Bar-L by now.
