You can sue for personal physical injury, mental stress, bad behaviour by employer etc etc etc - if you want to.

It doesn't mean you will win, of course.

But if somebody who was directing me in my employment physically struck me, I would be very, very, very upset and would definitely be minded to make them pay financially. I would also take the employer to a tribunal as well if

a) they condoned - either explicitly or implicitly - the action
b) failed to take action against the person who carried out the assault
c) failed to provide an environment where employees were protected from thuggish behaviour

It wasn't "just" a random slap though, was it? There are a lot of factors in the mix. Some/most of the award may be a reflection on JC's stupidity and on the BBC's failure to control him.

As I said earlier, I like JC as a presenter but he's behaved like a pillock in this case (which to be fair to him he's acknowledged). It seems the price for being a pillock is £100k.

A bit of a reality check for those who were complaining about the BBC taking action. Do people now see the legal risks of 'allowing' (as they would if they hadn't taken action) such environments to exist in their organisation?

I would say good luck with that lot, however most employers would settle as they cannot recover any of their costs

Depending on their insurance they can recover some/all costs.

Yes. It's common to have cover which includes compensation rewards. We've used it a couple of times.

If the insurance company thinks they can't win the case they might offer a settlement but we've had it go both ways. One successful claim and one settled claim. Both times we were covered for the majority of the costs.

Thing is I can understand compensation for the physical side of it, but where does all this racial bks come from? Irish is not a different race, he's still white.

Why would that bother him. He has 100k+ burning a hole in his back pocket, a promotion, and a job for life at the BBC (can you ever see them getting rid of him).

Also I can't see why it would affect his future career. As many people hated Clarkson as liked him (or TG), and he wasn't the aggressor.
