AFAIUI if you switch party you need one, not if you carry on as an indy.He's doing the latter. In the past he did the former.

That is irrelevant. An MP (or Lord) leaving one political party to join another is called 'crossing the floor'. There is no obligation to hold a by-election.Welshbeef said:

I would think protocol is that a by election is held. Don't know for sure

An MP can indeed defect without a by election, many have done so. Day 1 of the new parliament MP who was a punk decides to be a brown MP it's a two party only Govt you'd instantly have a change in govt
