They'd both been in the driving seat at one point but said the other was driving at the time of the crash.

Well it probably wouldn't be murder anyway as it's unlikely their intent was to crash and kill the pedestrian. What happened to "joint enterprise" though?

For a joint enterprise conviction you need to show that all parties were aware of the risk of a crime taking place, which I don't see that you could in this situation.

You'd like to think the police have an idea which one of them is lying. And then bug them in the hope they admit it.

Offer them both a lie detector test, presumably if either are innocent they will take it. I don't know how accurate they are but that's not really the point.

It's the 11 hour wait to dial 999 that is a blood boiler too. Surely they can both be done for this if the baby was in dual care. If it's not classed as dual care then surely the mother should be checking on her toddler within the 11 hours. Poor kid. Smashing a toddlers head against a wall is a hell of a burden to live with, I hope it proves to be too much for whichever of the cowardly scumbags did it.

Lie detector would sort this out, they use it in the states to guide police enquiries and Jeremy Kyle uses then to very good effect.

I can't believe this will end here.

One occasion where the use of a tiny bit of torture can by morally justified in my opinion. I doubt it would taken much for one of them to crack. I wonder if the police in the 70s would have used slightly more robust interrogation techniques than today?

They're both guilty at least of negligence, which led to the murder. Any competent legal system would have them both off the streets. We just don't have one.

From the CPS, through the legal profession to the police, we are sadly lacking.

Yep, that hit me hard - then came the picture of the mother visiting him in hospital (which I assume is the from the incident going by the boy's injuries) with her arm round the dad before he found out the truth!!! fking scumbag. I don't care if she wasn't the perpetrator of the assault, but that poor little kid would have had a hell of a bump on his head almost immediately and she took 11 hours to get him attention.
