It may get legally very nasty but it won't be complicated. He was driving so there isn't really an issue at hand. It will cost his insurers though but that's what they are there for.Horrible situation for all involved though.

O/T but I remember that, the A446 just after the Belfry nr Sutton Coldfield. I've been round that bend hundreds of times in my yoof in my MG Metro, delighting at how awesome a corner it is, but easy to get wrong with too much power on tap I expect. Now when I visit my folks I always treat it with a lot more respect, because of that specific accident. Someone stopped the next day after seeing a reflection from the car through the bushes.

If the driver owned the F50: was it insured to be driven in those circumstances?
If the F50 was one of the ones being stored as part of the driver's business, I would guess that the business' insurance may well not cover "taking people out for a cheeky ride".

And on the point about the driver being past caring what happens to him, maybe just at the minute, but once he is back on his feet, his defence will almost certainly begin. Just human nature that.

Overall though, in the case of the OP, this is a horrific accident. All involved have my sympathy.
