The only sure fire way would be to film the entire encounter to show the level of willingness and active participation on behalf of the woman throughout the encounter.

I wonder what the court's position would be if an accused man did produce video evidence (perhaps from a hidden camera). Would he get off with rape - but then be prosecuted for invasion of privacy?

It's a sad state of affairs when the advice i sent my son away to university with was "if you wouldn't trust her behind the wheel of a car don't shag it and always wear a rubber friend, never trust her when she says don't worry i'm on the pill" i accept that most girls are completely trust worthy and wouldn't dream of screaming rape or getting pregnant deliberately, but unfortunately he won't know which ones the nutter till too late and unfortunately there is no longer any premise of innocent until proven guilty and even the court of law is almost redundant as most cases are tried in the public press before then.

Neither is going to look good on the CV I suspect.

I've given my step son the same advice. Also to never use a condom given to him by said girl/women.

I have an acquaintance who has been through this scenario.

What She said had happened was that she agreed to go with him to a function as a friend. She got incredibly drunk and on return to the hotel room (which she was voluntarily sharing with him) she threw up due to alcohol and then passed out, only to find my friend raping her. She claimed that she began to cry and shouted at him to stop but he only did when she physically forced him off. She then ran downstairs and rang her boyfriend to come and pick her up. They then went to the nearest Police Station to report it and my friend was woken and arrested in the early hours. Following being charged he was named and shamed in the local and national News.

Following the trial he was found not guilty due to excellent testimony from several independent witnesses who had seen them kissing and cuddling all night and one who had held a fully coherent and in depth conversation with her just before they left in a taxi. Other witnesses stated that she was fully aware during the taxi ride back to the hotel and on arrival at the hotel. He also stated that she fully consented but then became concerned about cheating on her boyfriend and fled the room. When he was woken up by the Police knocking on the door he assumed it was her coming back.

Unfortunately his name is still mud despite being found not guilty and there will always be those who will never believe him despite the findings of a jury based on all of the evidence. It's very easy for a disgruntled woman, or one who is scared that her boyfriend will find out what she's just done, to just make something up and there is an immediate inference of guilt on the man's behalf.

Not for a second trying to distract from the genuine victims out there, I can't begin to imagine how horrible an experience it must be, but I bet there are a lot of vindictive women out there who will destroy a man's life to hide their own mistakes, as does seem to have been the case as above.

I have actually had this happen to me - although it didn't result in a rape allegation.

Said girl was fully up for it - but had pangs of guilt half way through and wanted to stop (which we did). This is despite the fact that she had supposedly broken up with her BF a few weeks earlier (I later found out that this was BS and she was still sleeping with him - hence the guilt trip).
