Rezzas Abdulla, 33, spat in the face of a nine-month-old baby while she was in her pushchair last January.

It sounds from the article, and the description of the incident, that he has a pretty serious mental illness. He's 'avoided jail' in that he's got an 8 month suspended sentence conditional on him receiving treatment.
That seems sensible to me. All that locking him up is likely to do is make him angrier and crazier for when he gets out again.

It's practicality. He's committed racially aggravated assault, with no injuries. The maximum sentence is 2 years not 'the rest of his life'. If you magically change the law so you can lock him up for the rest of his life. That would cost, roughly, 1.5 million quid over his lifetime. Sensible use of resources? Obviously now it's time for the tirade of angry posts suggesting that we simply shoot him in the face and feed him to the pigs.
