Yes.

There is no territorial limt. Scottish courts have ruled that any tweet etc read in Scotland is deemed to be published in Scotland. So anyone, anywhere in the world can break these laws.




In practice, it will be tricky extraditing someone from say the USA for saying that a transwoman is not a woman etc.

Unlike us the USA has pretty good free speech laws.

The rest of the UK - easy. Scottish courts just need o issue a warrant and the police will arrest you anywhere in the UK and bring you to Scotland to face justice (of a sort).

Hence Wings Over Scotland being taken down until legal advice obtained.

Exactly no, because the devolution settlement and the Scotland Act did not put in place a recall procedure for Holyrood.

Westminster implemented one in 2015, hence Margaret Ferrier getting the boot.

Alister Jack has said that he's ready to start negotiation with the Scottish Government regarding introducing this valuable tool of democracy that the rest of the UK enjoys to Scotland!

Bizarrely, yes!

SNP ScotGov has drafted a string of appalling legislation, but this one takes the cake for over-reach to the point of being impossible to implement without exhausting the already over-stretched resources of Police Scotland, meaning selective implementation will need to occur leading to a complete discrediting of the legislation.

Our lurker Edinburger took his usual 'something must be done' approach to this when it was just a Bill, citing again the generality of the good intentions rather than the specificity of the language of the law that was being proposed.

The unintended consequences of this law (because of yet another failure to draft it in the context of pre-existing provisions and legislation) will make the ridiculousness of the The Offensive Behaviour at Football and Threatening Communications (Scotland) Act (repealed) - where something could either be or not be an offence depending on whether you were travelling to or from a football match - look positively credible.

He has obviously decided to milk the system for every penny
No, because we have kinder, gentler politics the SNP decided we didn't need a recall act. Although it wouldn't apply to Mathieson as ScotPlod haven't investigated datagate, never mind got a conviction.

I watched an interesting BBC Scotland Disclosure documentary about a guy from Inverness who after being charged with rape fled to the USA and faked his death. Dead Man Running. Recommended.

While there I happened to see another episode about Sturgeons resignation. Gave me a few laughs anyway. Especially the start where they say how highly everyone rates her.

I have to say I’ve never been so angry politically about a proposed change.
Utterly bizarre how this ever got into law. Suddenly makes a second revising chamber seem like an extraordinarily good idea.

Nevertheless we are where we are.

Sweepstake on how long this nonsense will stand up before it all falls apart?

It’s tempting to trawl twitter worldwide for offensive posts, and report them to police Scotland who will presumably then have to investigate them all. Will be a never ending job.

So, in theory, if I read a twitter a/c from a Hamas follower in Gaza or alternatively an Israeli activist in Israel, who had an online hateful rant about the other this spat between two people thousands of miles away becomes a Scottish hate crime because it was published in Scotland.

The crime rate is about to rocket.
