IIRC, the law was changed recently. It may have been in response to a Security Guard who had a go on a pissed girl passed out in the corridor of a university a year or two back.

Not saying I agree with it, but it's a reason to be careful in such situations.
It was at my old uni Aberystwyth. She retracted her consent after giving it under the influence. I dont know how long that judgement will stand.
I gave myself consent to drink drive once, but the crown court never accepted that it only happened because I was drunk. They banned me for a year. I told them I never drink drive when I am sober, and only ever do it if I am really drunk, too drunk to make intelligent decisions, but they could not accept that simple fact.

How come some drunk girl can put a guy in jail just because she made a bad decision when drunk???

As far as I am concerned you should never have sex with a woman if she is pissed (not tipsy), especially if she is unconscious through alcohol, and more so if you hardly know her. Full stop.

If you do your a prat. shoot
That'll get the birth rate down, it seems a bit harsh on the ugly people though they'll never get any.

what about if you are both w@nkered (as in this case?)
Never!

Its just not worth the risk, and anyway surely you should have more respect for the lady you are with?

I have been in this situation before, and even in my wkered state I was man enough to realise it was not right.
Next morning mind we were at it like rabbits!

And it wasnt even easter, although I did have some chocolate....
Never woke up next to a quadruple bagger and felt like you've been raped yourself?

The law now implies:

A drunk man is responsible for his actions.
A drunk woman isn't responsible for her actions.

Therefore men must be superior.

Out of interest, is there scope to claim you are too drunk to seek consent?

Just another piece of well meant law, which in practice criminalises the man before he is tried and convicted. No down side for the women though. At her age, she shares responsibility with the man, as to what happens after drinking to much and not knowing whether she actually gave consent or not. If he is found not guilty, the women’s name should be made public as a warning to other men, to give her a very wide berth. All this old pony about this will put women off coming forward and reporting rape is just so much old baloney. This man's rights to be treated equally with the women’s anonymity just don't seem important. Just more sham justice for men. If this country ever ends up with Sharia law, women may rue the day they dismantled men’s rights in cases like these.

In these cases I don't understand why both parties can't be givin anonymity until after the trial...if the guy is innocent then there's no need for his name to be released afterwards either...

when she asked "did we have sex" and he said yes, she went mental and cried rape....

So why did he not just say....."ahhhhhhhhhh, gotcha!! Course we didn't I'm winding you up!!, Now pop your knickers on and make me a cuppa will you?"

Surely a more canny response than calling the police and reporting the "rape" himself!!

Almost a Darwin award required for that!

Nail on head.

It makes me sick how possibly innocent people can have their lives ruined by being named. People automatically assume he is guilty if he's accused, let alone taken to court. I am completely in agreement that the woman should be named if he is acquitted, but it never happens does it?

Didn't think it was law though. I thought the guidelines for consent had been changed, and that a judge has already thrown this out in a previous case.

The law does not recognise a female rapist. A hard on constitutes as consent.

Surely thats utter st?
What about if the woman's nips go hard? Does that mean she's consented too?

Just because someone gets a lob on doesn't mean they consent to sex.
