Can't believe my mother received a letter from the IR yesterday addressed to whoever is dealing with 'the late Mrs BC's estate'. It seems that the IR have decided that she is dead when she is alive & well albeit now rather peed off.

Mum's upset about it but should I complain or try to get her to laugh it off?

Laugh it off, it's obviously a cock-up. Get your mum to write back advising them that as they reckon she's dead, she's come back to haunt them - for all eternity.

1. Open a Ltd company with her as director.
2. Go contracting, and have her company employ you.
3. Take all the income as your salary.
4. When/If the IR come after her, just inform them that she's dead,'cos they said she was.

Write back to "Whoever is handling the closing down of HMR&C" and ask why they believe she is dead.

Update. It now seems that due to the above the DWP stopped paying my mother's pension in March becuase they had been informed she was dead (it took her until now to notice).

We have somebody from DWP coming to see her in 2 weeks to confirm she is alive. They want to see her passport etc., which in a way sounds fair enough but what proof did they have that she was dead? They won't say.

I have complained to the DWP and HMRC under the data protection act on her behalf requesting disclosure of how this all happened. Her MP is also on the case.

This has seriously freaked my mum and I'm finding the government departments very hard to deal with.

Sadly these things happen. Take a very big computer, add lots of 'systems' and 'policies' and staff it with 10,000 numpties, and what do you expect?

When my mother was in a fully self-funding care home she TWICE had her allowance AND pension turned off because someone had told them it was a council home. Just dig in, present the facts and right the wrongs.

So, her physically standing there talking to them is insufficient to confirm she is alive? But a passport will do it.. Sounds about right for the Govt biggrin

Just because a human being is standing there is no proof of identity. And that is not just something that applies to government bureaucracy.

So she is required to prove that she is alive but they are so far refusing to say why the think she's dead. Does that sound reasonable to you?

I was not commenting about those particular aspects. I was commenting on "proof of identity" - which is a big problem for many organisations.

HMRC is a massive organisation and they handle the personal details of tens of millions of people. Even if they are right 90% of the time, that still means they get things wrong for hundreds of thousands of people - all the time.

I'd interested in the tests HMRC have to verify that she is not a zombie or for the matter that you couldn't declare yourself as dead and risen again?

Could be a innovative new form of legal? tax avoidance.
