I went to visit an elderly family friend today. He has been very poorly over the past few years. In conversation he happened to mention that he wonders how much the CGT will be on a buy to let he sold in 08/09. After a little digging he finally admitted that he hasn't been filing self-assessments since 07/08. He is retired with a couple of buy to lets.

I was initially confused about why he wasn't being chased. He then appeared with a stack (3" deep) of brown envelopes. I brought them home and working through them. They are making assessments and chasing for payment by enforcement by distraint.

His admin is in a horrendous state and I doubt he'll be able to prepare a return for last year let alone 08/09. This may be a silly question but is there a way to pay an amount to HMRC and not file. They appear to have estimated based on history but I doubt they'll accept no return.

I have said he should send off medical records as they will probably help reduce some of the penalties.

Any help appreciated.
