OP, the debts secured on the house are already near its value.

Have you other debts too not secured on the house, might you be better off declaring bankruptcy?
Rather than selling his house and paying what he owes?

It's very sad to hear people suggesting this - not only for creditors but also bankruptees and IVApeople have the stigma around them forever after.

Fotic, regardless of your personal feelings on how people deal with their budgets, the chap is honest enough to come on here, bare his soul, and ask for help.

You're not helping. In fact, you're coming across as petty and not a little vindictive. His choice of car to house value is exactly that, his choice. Some would rather have a nice car than a mansion to park it in. No one should (In my opinion) lose their home over an unsecured debt, thats why unsecured borrowing rates are so much higher than secured.

OP, good luck to you, and I hope you get a favourable outcome.

OP, there's another forum group online called legalbeagles. They have helped numerous people in your position. They only give advice, but several members are retired law professionals and they have a wealth of information.

This is in no way a recommendation to go to them rather than a practicing solicitor, but they may be able to help.
