I'm not sure if this should go here or "Health Matters" :-)

I've just got word that an organisation I contract to, via my Employers (a Partnership, if that makes any difference) are being investigated by HMRC for compliance (most probably IR35). As part of that investigation I've been asked to supply my NI No. and Home Address. Even though every payment for my work gets paid to my employer and subsequently to me via PAYE, so no reason for me to be personally involved, or HMRC to mark my card.

Having been in the grips of HMRC torture IR35 & Self assessment before, which had serious health implications for me, I've purposely avoided anything that would require me to undergo Self-Assessment since.

So do I have to acquiesce and provide these details willy-nilly, to this organisation? I'd almost rather give up this work rather than have to go through having to do Self Assessment again. In fact Can I stop now, to avoid this happening, or is it inevitable I'll be put in the "must do a self assessment" pile, regardless?

Who is asking you for the information - your employer or HMRC?

I am assuming that you are paid a salary and that this salary is properly processed in its entirety through normal PAYE channels by your employer.

Your assumption on salary and PAYE are completely correct, with regard to myself.

I do a small role for an NHS body, but invoice and payment for this is paid to my employer and not to myself.

HMRC are looking at the arrangements of The NHS body with regard to their roles and projects, to see if the roles should be as an employee or self-employed basis. But I don't want to get dragged into having to complete a Self Assessment, when I don't actually derive any (personal) payment for the work, that would offset the inconvenience of having to complete the Self Assessment.

The NHS body has been directed to provide details of any "off payroll" payments, my argument is that I haven't been paid, my employers have been paid for my work and that as a PAYE employee, I shouldn't have provide my personal details for payments I haven't personally received.
