My parents built a house, they bought a field from a farmer and plonked a house on it. This was 25 years ago.

The access to the field was set back from the highway at an angle, so that the gate would have been away from the road. The deeds for the field showed the boundary following the wall and gate.

This left a small triangle of land, maybe 4m x 2m, that wasn't owned by the farmer, between the plot and the road. For context it's a back road in the Lakes that links two villages and is primarily used for farm access etc.

Anyway, at the time the Council denied ownership, next-door's deeds showed it wasn't theirs and there was no evidence of any owner anywhere. There's no real issue with access, ransom strips etc as it's been in continuous use for a very long time with witnesses available. It's also pretty unlikely that someone else would actually own the land, it's just been missed when various maps were drawn.

My parents plan is to down-size in the next few years and my Dad would like to tidy this up if possible just in case it causes issues on sale. I'd expect it to cause a delay, but not be an actual problem.

Anyway, my question is what are the options? Is it possible that my parents can make a claim on the land and register it with the land registry as part of their property?

They should be able to get an insurance policy to indemnify any new owner against access being denied.

Sounds fairly straightforward.
