Appreciate some advice

I own a flat where the management company have polled owners on whether we use their contractor to carry out external painting

I obviously voted no but given the number of residents who said no wasn't achieved to let each person do it themselves or chose their own contractor they are now forcing me to use their contractor to carry out the works along with everyone else

Can they do this?

The flat is a one bed with two external Windows and my potential liability is £750ish. Whilst I appreciate there will be some communal areas which need doing, I think £750 is crazy.

The flat is in Yorkshire so we aren't talking crazy London contractor rates here!

What can I do to stop them forcing me into an unfair position?

Last time I looked, they need to provide you with 3 quotes for the same spec.

What are they actually forcing you to do?

If the works are external and common parts decorations, then it is customary for the management company to obtain competitive tenders for the works from 3 or 4 suitable contractors, rather than choose a single contractor only.

You need to refer to Section 20 of the Landlord & Tenant Act 1985, link below;

Where the total cost of the works is equal to about £250 per leasehold flat, ie total cost for four flats is £1000, eight flats £2000, etc. etc., the the management company must obtain three contractors quotations, submitting the same to leaseholders, for the leaseholders then to select their preferred contractor.
