Had a similar situation. Tracked the original house builder down, asked permission. Paid £250 admin charge and got permission. It's simply a revenue stream for the original builders.

I have managed to insure against some restrictive covenants recently where the risk I would have said is far from nil! It entirely depends on how you present the risk to the insurer, the more leg work you do, the more they are inclined to take the risk.

That's my point, you do the leg work to satisfy them and in doing so you pretty much satisfy yourself that the risk is negligible.

In 30 years I have only claimed once (20years ago) , and could have avoided that had I had a better understanding of rights of way and intensification of use.
