What tree is this?

Fell into my garden. Neighbour said he will pay to have it cleared up and replace fence but wont pay for smashed bench/arbor.

Use the wood to make a new one before he takes it away. The wood once dried makes a lot as firewood so no wonder he will pay to take it away!!

Any guess at what tree it is? Im hazarding a guess at oak looking at the buds coming through. Bit hard to see.

I am no expert but I would have thought an oak that size would have a larger trunk. I would possibly say birch.

the tree kind of splits in 2 not far off the ground - this was one part of it. The other half is still standing.

For now it is. Best make sure your neighbour employs a specialist to make good what was left behind. I wouldn't want any more falling into my garden.

It clearly isn't birch but beyond that hard to say - could well be oak.

Was he negligent? If it came down in the storm, then I doubt it. It's still his tree, so he's responsible for getting it off your property. If the fence it damaged was his, then of course he has to fix it. If it was your fence then he wouldn't be. He's certainly not responsible for your garden furniture. His insurers may well cover the tree removal and his fence, but they won't cover your damage, because they only cover his legal liability to third parties and he wasn't legally liable if he did nothing wrong.

It's not his fault you have garden furniture. It's yours and if it's of value, you should insure it. For all he knows you could have a £100K statue in your garden. Would you expect him to fork out for that too?

It'll be down to the OP's insurance to pay not the neighbour - OP's insurers could claim back from neighbour if liability can be identified....fat chance of that though.

He said he isnt insured so paying out own pocket. His tree. I noticed last summer it all looked dead as only one half of the tree had leaves on it.

Well on the upside there is chap on here that's neighbor will not replace the blown down fence. Even though it's their side. At least yours is replacing the fence and removing the tree.
