Are you sure the advert said "Brand New In Box" and not "Brand New Box"?

box was sealed, but inside the seal was off the box, so this happened at the Amazon warehouse.

Did the amazon box have any tape on it or any damage from being dropped/ opened

Iv had it before when something from amazon and been tapped shut as it clearly had been opened to see what was it in.

phone box was cellophane shrink wrapped, seal in place, yup, 100% new phone untouched since it was packed at the factory is here
