The contract was formed in such a way that the buyer was led to assume that the dashboard was in fully functioning condition. Yet in fact the buyer was not made aware of the vent issue.

You've answered your own question.

Caveat Emptor, which, as you accurately translate, means "buyer beware", implies that the buyer accepts the risk of making the purchase, and is generally deemed to have carried out whatever checks he feels appropriate priot to completion. And yet, in the same sentence, you're advising to open a dispute. If you've bought according to Caveat Emptor, there's a clear assumption that you accept the risk, therefore you wouldn't revert to the seller subsequently. You're advising two diametrically opposite approaches.

However, in my opinion, in this situation, I can't see how Caveat would apply.

That isnt surprising .. what is surprising, noone has suggested VBRJ as a solution ...

It isn't as described so send the fking thing back. 7 days no quibble return policy for business sellers. That's how Ebay works.

If there was bascially no description of the item you should have asked a question or two - like 'Whats the condition of the item ?' and 'Does everything work ?'.

Then later on if you have problems you can qutoe it back to them.

Anyway - can't you use the vents out of your old dash ?

IMO I don't think it's worth bothering with, just swap out your current vents into the new dash, or fix the vents, probably just a lever that has come off?!

I would just swap the vents over, and get on with life.
