Caveat Emptor, which, as you accurately translate, means "buyer beware", implies that the buyer accepts the risk of making the purchase, and is generally deemed to have carried out whatever checks he feels appropriate priot to completion. And yet, in the same sentence, you're advising to open a dispute. If you've bought according to Caveat Emptor, there's a clear assumption that you accept the risk, therefore you wouldn't revert to the seller subsequently. You're advising two diametrically opposite approaches.
However, in my opinion, in this situation, I can't see how Caveat would apply.
