He'd have to offer a warranty as a trader/dealer, but the fact he's not openly admitted he's selling a number of other cars as far as EBay are concerned is indeed the big question! I seem to remember if you buy/sell more than 3 cars a year you're classed as a trader/dealer. The evidence isn't stacking up well on this although I'd ask 2 further questions if you don't want to ask him outright if he's a trader....1) how long has he owned the car? 2) is the vehicle logbook in his name?. I'd suggest also checking the car is currently taxed to see if that matches up with when he claims he bought it as traders often don't keep the cars they're selling as taxed for cost reasons.

Do you really want to be buying right at the bottom of the market with a dubious service history, a number of expensive repairs due and a bad gut feeling?

Hold back and wait for one which is properly sorted, there have been quite a few early ones for around this money.

I've seen a few S's about at the 33k mark which you might want to up the budget for.

As the 400's start to drop in price we should see NA models pushed down either further.*

Great position to be in, take your time and enjoy the car when you find her!

Just a quick update to thank you all for your help and to update you on what happened. Basically I procrastinated and missed the car! I'd offered £23100 and the seller said he'd accept £23750. I should have gone for that but foolishly decided to think about it and hope to perhaps get the car for £23500. Big mistake! So the search continues..... Once again thanks for all the help.
