If the authorities have been aware of the evidence before the original trial then it legally has to be disclosed to the defence team, does it not?

It never added up if you read the full version of events.

Girl was supposedly comatose but was able to walk out and pick up a pizza as clearly shown on CCTV.

If I was innocent I'd be out for blood. I'd be most angry at why my defence didn't have this evidence.
It shouldnt work like that
There should be enough evidence to prosecute and convict even if you have no defence evidence
You shouldnt have to round finding evidence to prove youre innocent
The prosecution evidence was either there or it wasnt

'Evidence' in this case could have been created after the event.

How does he stand WRT people like Jessica Ennis - Hill effectively putting a halt to him resurrecting his career though? Could they be sued for defamation & other bits 'n' bobs?

In my opinion, yes.

F list tool, perhaps? Hardly Elizabeth Taylor is she?

He was convicted, he is now facing a re-trial. Lets see what the re-trail reveals.
As I see it his conviction on the evidence at the first trial has been deemed 'unsafe' and therefore he's facing another trial. Not quite the same as being exonerated I would think?

Complete guess but I'd say not. Calling a convicted rapist a convicted rapist wouldn't be defamation I'd have thought.

What would happen to him if he’s found guilty again? Back inside or as he’s already done 2.5 years would he be let off?

I'm no expert, but I'd imagine he'd be nominally imprisoned, for the 2.5years already served, so no additional time to do but again convicted, with all that is associated with that. It would be rough justice for him to have to do more porridge, given the circs of this case.

Good luck finding 12 people who don't have a prejudiced opinion on the events or the man... I can't see how he's going to get a fair trial. Anyone know what the new ecidence was that led to the appeal?

That now is the main problem, he was not only tried by the original jury, who based on what was presented made a decision. That decision is now seem as wrong so a retrial is the only way forward. Knowing how high profile this case was the new evidence must have been pretty strong for them to do this.

The next step is they have to find 12 people who can divorce morality with criminality as most find what he did abhorrent, however not illegal if his and the other footballers version are believed.

How likely is it that you can find that after all the salacious articles have appeared and the high profile feminist backlash? Will the CPS even want to take it again, as they have no new thing to throw at him, but his defence clearly have something to throw back and what if the star witness does not want to go through it all again?

It is a dilemma but the loss of his income will be a key thing and maybe he could go after those high profile people who have been at the forefront of the mob if he is found innocent.

Who are you talking about? Jessica Ennis-Hill presumably, who said that she didn't want her name on a stand if Sheffield Utd re-signed then convicted rapist Ched Evans?

Given that he was actually a convicted rapist when she said that, what claim do you think that he has against her?

Being found innocent isn't one of the options. There's guilty or not guilty. Even if not guilty, the whole sordid tale isn't exactly a glowing endorsement of his high moral conduct.

Can anyone give a rough indication/speculation of what the new evidence might be? Most likely to be a witness changing their mind or coming forward or what? (Reliability issues???)
