van de Garde sueing Sauber

Giedo van der Garde is suing Sauber demanding that he should be in the car next week. Seems he believes that his contract for last year ran through this year and he should have been driving for the team this year.
Given that he's chosen to launch the action where he has i.e. where the Australian GP is within the court's jurisdiction, I suspect he want to pressure the team into some kind of settlement as the court could prevent Sauber from competing next week. I doubt that he would actually want to be in the car - can you imagine how little support he'd get from the team ? I wonder if Sutil will do something similar, as I understand his contract also ran to the end of this year too

I read somewhere that GvdG was paying Sauber for his drive. Maybe he feels he's due a refund, or perhaps he paid something in advance? Some other info from the net;
- VdGarde had a clause in his contract saying that if is contract wasn't ended by Sauber before the 28th of june last year his contract was automatically extended for the 2015 season.
- VdGarde already won the case against Sauber last week in front of a Swiss court (Sauber is running under a Swiss licence); saying that indeed VdGarde has a legal contract for the 2015 season
- The case now in Australia is to make sure the contract is being met in Australia; that the already existing Swiss verdict is taken over and can be executed at once. This could in theory mean that if VdGarde wins the case on Wednesday and Sauber does not cooperate, VdGarde could be given access to the car the coming weekend with help form the Australian police.
- Sauber not only defended itself in front of the Australian court by saying that it will be dangerous to give access to the car because VdGarde does not fit in the car. But also that VdGarde does not have a Super Licence, which is a bit stupid; he has one and tested for Sauber last season.
Will probably end with a financial settlement.

O, and another thing which I read on the net; I don't know if it's true but Sauber in 2011 during the Canadian GP in Monreal changed drivers 1 hour prior to the race; Pedro de la Rosa (who wasn't even under contract with Sauber) replaced Sergio Perez.

Not quite. Perez drove in first practice but, still suffering from the effects of his shunt at Monaco, decided to take no further part in proceedings. So that's how dangerous Sauber feels it all is......
de la Rosa, who was McLaren's reserve driver, then filled for Perez throughout the rest of the weekend.
That, of course, does nothing to help Sauber's stance re. VDG...

It seems like they must have been in a lot of financial trouble to breach VdG's contact like that. Maybe Sauber wouldn't even be racing in 2015 without money from Ericsson and Nasr, which kind of makes VdG's actions a bit of a paradox.
There has to be some sort of financial settlement here. I can't see VdG driving for a team he had to sue to get a place on. Not only that, Sauber would have to pay off Ericsson which could be messy and expensive.
It's pretty sad to see really, as they have at least looked reliable in pre-season testing.
