Say mclaren were to swap to merc engines that were destined for manor, manor I belive were using the Williams back end ie gearbox and suspension, I think it's fair to assume mclaren's gearbox wouldn't fit the merc engine so as well as modifying the back of the tub to accept the engine they'd also have to rework the gearbox too as it very unlikely Williams would agree to mclaren having their gearbox and suspension

But true, nonetheless. I'm aware of one individual for whom that was a bridge too far. But as I don't have a copy of the Concorde Agreement, I've got no idea what that says about successor entities. I'm sure with a bit of a will there would have been a way to register the team as a new team, even if that does need the consent of everyone else. I can only really see Sauber not being excited about that (threat of money for finishing 10th) but surely it doesn't serve them well to be consistently at the back? When they're racing they may be getting TV time ...

The liability would rest with the company. If you put the entity owning the entry through a pre-pack to shed any potential liability, you lose the entry itself. So you can't shed it.
So you ask for an indemnity, which nobody will give to you.

That was pre 1.6 engines though, I think the rule regarding a more standardised mounting point was amended for the new regs.They chose Merc because it fitted better.
