reply from consumer diret
Dear Mr Leivers
Thank you for your enquiry to Consumer Direct dated 23/06/2011
Your reference number for this case is ********** and should be quoted in all further correspondence regarding this case.
Based on the information you have provided the key legal points in response to your enquiry are as follows:
When you have services carried out, you have rights against the trader under the Supply of Goods & Services Act 1982. This provides that work should be carried out with reasonable care & skill, for a reasonable charge (unless the price is fixed by contract), and within a reasonable time (unless the time scale is fixed by contract). It also provides that any goods & materials supplied as part of the service should be of a satisfactory quality i.e. free from defects.
If the trader has failed to fulfill the above requirements then he should come back and rectify the problem, without additional cost.
If the trader has breached the above act and you have given him/her the opportunity to rectify the faults without any success you could argue you have lost faith in his/her ability to carry out the work.
If this is the case then you may instruct another trader to rectify the faults and claim any costs back as consequential loss. You must inform the original trader before allowing another trader to rectify the faults. You should then proceed to request 2-3 quotes from other traders and forward these to the original making him/her aware of your actions.
I would advise speaking to the company in the first instance to see what they are willing to do and if the issue is not resolved make a more formal complaint via a recorded delivery letter (keeping a copy for your records).
There is a template letter available on the website if required
If the response from them is not satisfactory, please feel free to get back in touch with an update and further advice can be offered.
If the trader was threatening you or you felt intimidated by the trader this would be an issue to report to your local Police.
I will also make the details of your concerns available to Trading Standards for consideration. Your contact details will be made available to them and they can contact you directly if they require any further information or are able to provide feedback in relation to this enquiry.

Real world: Unfortunately, if they haven’t changed the engine by now, they never will. Send them a letter by recorded delivery advising that as your car still hasn’t been completed, you will be removing it from their premises on X date. Arrange for the car to be transported back to a garage near where you live (plenty of car shippers / transporters on here, or put an advert on Shipley.com) get local garage to fix the problem / source a new engine and fit it.
Anything else is just wasting your time, if this is the same garage that was on the news last month, legal action will get you absolutely nowhere.
We all make mistakes and trust people we shouldn't, so take your lumps and move on.

can you remember what that garage was called or wher it was?
John, sorry but I cant name it on here (name and shame rules and all that) however I do remember that it was near or in some way connected to one of the big airports near London, it was a decent sized outfit, based out of a large oldish and rather dirty looking unit and they ran national adverts. In all honesty, you will be better off, just having the car collected and moving on, than spending more time on the current outfit.
You should have sourced and engine and took it to davis and purdy in Mansfield on Southwell Road.
Really sorry to hear this, it's really st when somethings wrong with your car and your struggling to get it sorted. Sounds like your in for some right fun and games here.
I would contact the police to see if these guys are linked to the Heathrow bunch as it sounds like it.

i have just been on the f a automotives website and if you scrole to the bottom of the page and click on recent activity he has edited contact details took his name address and phone number off his website wednesday
these people are professional chancers you need to get the car back the problem is they will refuse to let you get the car out of their work shop when you get there.you need the police to help but its not a police matter so they are not much help yet.
if you send a recorded delivery letter saying you will collect within 7 days if not fixed as per the agreement then go there in 7 days with a recovery truck to tow it away (with bits in the boot), problem is they will make it very difficult to recover it so you might be better to call the police just before you get there and say they threatened to stab you with a screw driver (that way they will attend) and say you just want your car back and show them a copy of the letter you sent with the recorded delivery slip.

I had the misfortune to use the airport sounda like chancers years ago. They showed me a cylinder head with a massive crack in it and said because the item was beyond repair I would have to pay a three hundred quid surcharge. When I said I didn't understand, he looked all condescending put his hand on my shoulder and said sonny we cant all be expert mechanics....I said no I'm confused about why the cylinder head from my Vauxhall Vectra would have Ford fking stamped on the side of it!!!
Walked to my car got in and drove off.

This sounds exactly like Heathrow Engines.
Their ebay ad for the Espace engine with 34k on it - quantity 2
Look at the website - dodgy. 100%.
Look at the feedback they've got - one of their satisfied customers is here - http://shop.ebay.co.uk/www*newautofit*co*uk/m.html...
Look at their items for sale - engines - in cars on the same ramps in the same workshops as your guys.
There's good advice above re the recorded letter etc. But if they aren't working on the car, I'm guessing if they have the car stood for 7 days, storage will be charged.
Tell them to stop work. Now. Ask them for a bill for the work to date - itemised, listing parts (none, I'm guessing) and labour hours. If they say the new engine is in the car, ask to see your old one. Look for engine numbers, check for bolts that look undisturbed on the engine mounts etc. Take a mechanic if you have to.
Betcha the engine in the car is yours. Betcha they don't have a replacement engine, let alone two of them.
I'd seriously consider paying the bill, just to get the car out of there.
Even if you have to call the police, trading standards, the AA, the Samaritans or the coastguard to get the car out of there - phone 'em.
