Presumably, by trying to access the (proper) OBD port without a key in the ignition. If you can, it hasn't been done, by above accounts. Though, how useful it is to have had the upgrade done, in the light of the forced downgrade mentioned, is rather questionable.

If you want to check if yours has been done, with the car locked put the key in the door lock, turn to unlock it and hold the key in that position for a few seconds. If the windows drop you don't have the update.

Slightly linked to BMW as mini's are from the same source, but noticed the other day after fitting a hud to my car and it flattening the battery over crimbo, the obd port on my r56 mini is also live at all time's, so possibly same potential issue's?
