An often asked question...forgive me.

Overstayed a two hour maximum stay period in a multi-storey by 30mins. ParkingEye Ltd sent a latter asking for £85 (reduced to £50 if paid in 14 days)

Ignore?

My understanding was that parking companies can now pursue the registered keeper for the money, so it's not a straight "ignore" any more. I think you'll need to write a cheque.

Current advice seems to be ignore albeit run risk that they take you to court. If they do go to court current opinion seems to be that they'd struggle to recover damages of more than the parking ticket value albeit other legal costs may be lumped in. Have I got it read

I still don't see how they can prove who was driving thus I'd hit the ignore button ...

The same friend was caught at a well known dogging site (they are beyond help) can anyone help me them with that too?

You only have to pay them what they've lost out on isn't it? So only 30 minutes worth of stay. Not sure how that works in free car parks though.

They don't need to prove who was driving. The Protection of Freedoms Act 2012 means that they are allowed to hold the Registered Keeper responsible for the parking infringment.

Are you sure? I know that is the case with the LA's but afaik (still) not the private companies?

As it's Parking Eye it's a little more complex.

From reading around (i'm in the same position with another company) Parking Eye are getting some press for actually isseing court papers to people as of late.

Sending a version of the letter in the below thread may be applicable to see if they have followed due process/have the rights to enforce:

Plus it actually costs them money when you take it to POPLA, so win win really. From then, until you receive a response with POPLA reference and answers to all of the points you can ignore without fear of penalty (shows reasonableness if ut went to court eventually), although my money is that they would just continue sending automated letters.

Money saving expert or similar advises sending £10 for full and final settlement against any 'losses' they may have incurred.
