Do they mean upgraded here? Or has he healed quicker? Why would how a person heals effect the prosecution? It's the crime being judged not after effects.
I don't know the reasoning but it sounds good to me. The after effects can be far more damaging than what constitutes the 'crime'.

Hmm, depends. What if they raid your house and push you off the stairs. In one scenario you fall and have some bruises and scars, in the other you break your back and are paraplegic for life.I agree to your POV, but I also think they should be held responsible for the effects of their actions, intended or not, also after their actual crime.

Neither got what they deserved it seems. Silly comment.
This is an interesting comment though
"Charges against the 10 bikers arrested for the attack won’t be downgraded because the victim’s injuries haven’t healed as expected, Manhattan prosecutors told a judge last Friday."

I think it is as it reads. This is an interesting comment though

The guys who smashed the car and the guy up won't be charged with lesser offences just because one of them came out of the situation in a wheelchair, they picked the fight and came out of it worst. There won;t be any sympathy from the prosecutor just because one of them didn't recover from a broken back.
Seems pretty obvious I don't know why the prosecutor is stating it, it might effect the sentence maybe for that one guy but nothing to do with what they are tried with.
I think they may have it the correct way around. I'm not sure how their system differs to ours in relation to stuff like this:

The motorcyclist that got run over was almost as embedded into the road as the embedded police officers that beat the Range Rover driver up in front of his wife and kid. I hope his law suit against the NYPD is successful.

I assume 3 & 1/2 years Stateside means 3 & 1/2 years?

Yes, Mr Lawyer. That's why your client has been sentenced for charges of assault in the second degree and riot in the first degree.
