To settle with VWFS they give a fair valuation of the car - They don't care what payments are left or how much they should have made etc. They just want what the item is worth in their eyes. (I didn't know this previously - I thought it was what was left on your finance - Purchase price minus fees already paid- etc)

VWFS said this car is worth £25.5k - We're happy to settle at that price... (i'm sure they'd make money on that as they probably got if for £26k without vat and I've already paid 3.5k on payments etc)

My insurance say - Our glasses guide says £24k.... Thats what we are paying...

The shortfall is £1500...

Because VW have bought me a car that is worth the same or more with the 24K they are happy to continue the agreement as at the end of the agreement they will have a car worth the same or more... (They will rarely do this apparently)

Answer is none as you are just hiring-leasing the car,are not the legal owner so are not liable for any sort of shortfall.
It's not the same as leasing from hertz etc. You get insurance with those agreements. Also you don't have to agree to take out finance and have credit checks etc...

Yet reading your posts you said:

You hired a car for six weeks.

1) My car gets stolen. Until finance is settled I have to keep paying my lease payments....

2) In the interim i needed a car ( this was my responsibility so I had a courtesy car for some of the time, I hired one and I then bought a run around- now sold)

3) I ordered a bmw 335d on pcp because VW didn't say they would NOT be replacing the Golf. They said the agreement gets terminated end of...

4) VW said they will try to replace the golf (I'd spoken to lots of people at VWFS and had lots of wrong information)

5) VWFS say they've found another GOLF R for me I just have to pay my insurance excess which is £150 as deposit on the car
I then cancelled the PCP 335D order

6) My lease continues uninterrupted an I will give it back as planned on the original date




I didn't have to pay the finance shortfall as they found me another car and continued the finance agreement. (very rare).

I would have to pay the finance shortfall if they didn't find me a car which happens in 99% of cases...

(I had gap all along so wasn't worried but my issues are with people saying you are not liable to the shortfall - they know nothing! I've just been through it and had the insurance and VWFS say to me you ARE LIABLE FOR THE SHORTFALL IF THERE IS ONE)

It begs belief that someone argues about what they "think" should happen with someone who has just been through the exact scenario being discussed...

If Gap wasn't needed for a lease why do they sell it and actually advise it?

I will ring VWFS today and ask them why,when I spoke to them three weeks ago they said GAP insurance was a waste of money.

Good luck with your new cars,leased Golf R and PCP BMW 335D.I hope you still have them at the end of the lease.PCP contract.

Thanks, I cancelled the pcp 335D order as can't afford to have both

Based on some of his responses I think he's struggling to understand the situation.

I have to say I'm amazed VWFS helped you out though - as you said, they do state that the agreement ends if the car was written off. And in the case that was discussed at length here where the guy was way out of pocket as he'd made a big upfront payment, they apparently offered no help at all.

Yeh I was expecting the same. I paid £2800 upfront and was expecting to lose all that.
I think they helped because they saw how much I'd been messed around by VWFS. I called 3-4 times and gave the details of the theft and it was never recorded correctly and wrong advice was given along the way...

super nice lady I dealt with..

I suspect your insurance had a 'new for old' clause in the agreement whereas they can either pay out on the deal or provide you with a replacement car under the agreement. I've had this a few times with our customers on contract hire, so long as the car stolen was under 12 months old. Hence you had to pay the insurance excess.

Why would you think that? He wrote that the finance company wanted £25.5k, the insurance offered £24k. No new-for-old involved.

Well, instead of settling off the finance agreement he was supplied with a replacement car. I don't know whether the first agreement was therefore settled off in full and a new one started, or if the new car was provided on the original lease agreement.

Unfortunately that is a business only lease price - their personal price is £272 inc VAT - more than 20% over the business price. I really thought the law said they could not offer different deals to different customer.

I'd really like someone to get to the facts about this.

I may need to take out a Contact Hire soon, but it will be on the basis of being given a car allowance and making my own arrangements about sourcing a car.

I didn't have new for old. I asked Admiral about this and they wouldn't do it. The new car was all down to VWFS

Car provided on original lease agreement. No new deal, same end date and payments etc

Well Mercedes and BMW seem to get away with it (and they must have fairly good legal teams?)

Only 5000 miles

Probably plus a admin fee buy cannot see it.

About the best deal around at the moment.

True; but it seems VW back tracked big time when they were brought to book over the Golf R deals. Perhaps someone needs to put similar pressure on BMW and Merc. Perhaps the legality has never been challenged.
