OP unless you have no reason to change lanes into the lane to the left then sadly its going to go 50/50. Depending on how much money is involved, your insurer might take it to court and let a judge decide but its normally only cases with a large sum of money involved that this will happen.

What the person whose lying is doesn't realise that instead of just her premium being jacked up she's now doing the same to your premium. Even if it goes 50/50 your premiums still get loaded with a jacked up premium.

As someone who deals with liability all day everyday - I would say at least 75% of claims that I deal with "someone" is lying, and the only way to conclusively prove liability is to have a dash cam or CCTV.

Good luck!
Thanks for your advice - and to everyone else for their contributions.
I am actually rather amused by just how far this woman is prepared to go to cover up what was quite a minor bump! To actually move the entire incident half a mile up the road takes some doing! Mind you, it does pose the interesting question as to how we were able to exchange details in the side street where she eventually stopped, given that that street is actually BEFORE where she now alleges that the accident took place! hehe

I think a camera might be the only way to go now so as to protect myself in future. What a palaver!

Edited to add: I genuinely had no reason to change lanes - I was in exactly the one I needed to go where I was going ( and I stated as such on the accident report)

I'd state the above exactly as it is word-for-word to your insurance company (and the other parties if poss)and stress that you are in no way to blame - let them think it over......

Exactly this.

Your defence is that you have no reason to go down that lane because you were going from X and going to Y and that using the left lane going to Z would take you miles out of your way. It isnt an absolute defence, however its enough to start picking holes in the third partys argument. Would they have needed to change lanes? Where were they going from and too? The side street is another additional one.

Sadly if it boils down to word against words then unless either party has independent evidence it tends to be a split. Your insurer CAN take it to court if there is enough outlay to do so, and you are prepared to do so. Its one thing lying on an accident report form, quite another doing it in court so if you are prepared enough to, and your insurer will support it, that maybe an option.

Unlucky, op. Unfortunately most people nowadays are dishonest. Without a witness you'll be going 50/50. I was reversed into while parked in a car park a couple of years back. The guy lied and said I hit him. No witnesses - 50/50. Just chalk it down to a bad experience! Personally I don't know how they can live with themselves...

I got punted off the road about 15 months ago, other party admitted liability and I am in court fighting itthis Friday, insurance is just a legalised scam in my eyes, I am £10k out of pocket .

Basically as I only purchased the car two week prior it seems my name wasn't on the logbook so in there eyes wasn't my car to claim for, the mind boggles.

Well we shall soon see.

Hope you get what you deserve in the end mate, stick with it, my solicitors reckon nine times out of ten they do this so you just give up.
