I've sold two cars with my personal plate on, and I still have the plate.

Spoke to the very reasonable buyers, if I remember I filled out the reg forms so that I was the grantee gave the new owner everything filled out and Told the new buyers what we were doing, they even posted me back my plates.

It was based on trust, the plates meant nothing to them and it's not hugely valuable.

This time I'm taking the plate off before advertising the car, easiest way by far. I think a lot of buyers for a car want it straight away.

I'm interested in the comment about removing the plate straight away online....will have to look into this one

Just click the link in my post immediately above yours.

FYI, this thread was started in April 2014.

Why bother with forms and all that old fashioned stuff?

I had the buyer at my house, handing over cash, I went on-line and took the 'plate off with immediate effect. Put the original 'plates on and he drove away after taxing it on-line. Insurance was already sorted as I knew the number going back on.

I don't think you need to fill forms and post stuff off nowadays? (Except maybe the V5.)
Can this be done straight away, I'm on route to view the car. I think I read on somewhere yesterday that it can take upto a week to switch over online but I may be confusing it with old info I read.

If it works straight away and IF the seller has the original plates it can be over and done with a little bit quicker. If not I think the way I confirmed a few posts up is what I'll suggest to the seller.

Apparently not at weekends
This service is available Monday to Saturday, 8am to 6pm.

However if you have the forms in front of you some people have sent them off and DVLA sorts it out.
Otherwise you have to wait for reg docs to return and rely on the buyer to transfer back the reg

hi, this is my first time on here, and i would like a little advice.
i bought a car about three weeks ago with a private plate on, and the owner asked if i wanted it, and i said yes.
so i signed the paper work on the v5 log book and we parted ways, about a day later she asked if she could have the plate back because they missed it. i replied that i have bought the plate and car and i was going to keep it with the car, in which they never replied back.
anyway about two weeks later i had a text msg saying i am retaining the number plate and this is a coutesy msg what i didnt need to give you.
and so i felt furious and had wondered why i hadnt received the v5 log book. i sent off the green slip i had to the dvla to see if i could at least get the log book with the plate on there.

my question is how can they do this without my permission if i had the new keepers slip and only signed the log book with the private plate on

unless DVLA have changed the rules to be nice to sellers, the plate is yours
How do you know they have done it?
say again what you have done with the green slip - didnt you need to tax the car?

If they still had the logbook then they could retain the plate using the online system. After they got a replacement v5 with the original reg on it they could then transfer the car into your name online, without needing your signature.
You then get a v5 with the old reg on it through the post.

If they've retained it, it's still yours - when you retain the numberplate, it automatically goes to the current keeper. If there's some confusion as to who the current keeper is, you've presumably got the new keeper slip, dated before the plate was retained, so even if the seller sent the V5C later, or altered it, it should in principle all come out in the wash.

Phone up the DVLA and ask them what to do. I've always found their phone staff helpful. The wait times can sometimes be quite long though.

Hi thanks for the quick reply. She msg me tha day after sale sayimg can she have the plate , and i replied no. Then she didnt send the v5 off thinking she could change the plate without me knowing. Then three weeks later she msg me saying this is a courtesy msg saying "im changing the plates and your log book will have the old number plate i dont have to tell you im doing out of courtesy" which i found appauling. How can she do this when i brought the car over three weeks ago.

Schoolboy error. Keeper and owner are not the same thing, plus it is up to the DVLA to assign the registration based on the paper chain. If the seller transferred the plate to a retention certificate after the car changed ownership but before registering the new keeper then they have the plate - end of.

Unless the buyer had a separate contract (in writing) to obtain the plate then it is going to become a buyer's word against the seller's argument (which will never amount to success on the buyer's behalf) and the DVLA will have no interest in the matter.

Suck it up (plus who is to say we will not see another post shortly presenting a story from a seller about a buyer of their car promising to assign their plate back to them because buyer was in a hurry to do the deal and take the car away, and then backed out of it three days later thinking he could cheekily keep the plate....?!)

PS. Sending off the green slip was a pointless waste of time and the exact opposite of what you should have done as that was the only evidence you had of the date of transaction and therefor your only (slim) chance of recourse.

Give up on this one as you have lost already. We don't know the ins-and-outs of you conversations with the seller, but legally they have done nothing wrong.

Except that she would have needed to transfer the reg before change of keeper, otherwise the reg would be in the OP’s name, and then sent off the newly-issued V5C, which the OP hasn’t signed so she would have had to forge the signature?

As a new keeper dont you have to go on line ( or to a post office) and tax the car with the green slip so as to avoid SORN?
https://www.gov.uk/vehicle-tax
The green slip has the reg number of the car as you bought it

Similarly both of you will have signed the rest of the V5C with the reg number on it
If shes gone and done a transfer she'll have a new V5C which you wont have signed

Hi. Yh i have only signed the v5 with the plate on and the green slip of the new keeper also has this plate on, also i have bank transfere statements with the amount and number plate on and also text msgs with dates saying she wished she never sold the plate and i replied that i was not interested taking the plate off the car. I also phoned the dvla to tell them of this and the advisor told me to send the green slip in to obtain a log book with my name and the plate on the v5 which i am still waiting for to be returned. So i think in theory is this fraud or theif. because she asked if i wanted the plate and that it was included in the cost and i signed the v5 with the plate on and at that time there was not a retainer on the plate.

Did you send in the green slip on its own or with a form V62?
How have you managed to tax the car?
Otherwise it defaults to SORN these days

No legal requirement for a signature from the new keeper. The process can even be carried out online by the seller.

You have not answered the one question everyone is asking you.....Did you tax the car using the green slip (V5C)??

If you did you have half a chance.

The fact you have bank transfers with the plate number, and a message saying 'she wished she had not sold the plate' also puts you in a good position.

She has now committed and act of theft.

I would text her back to say "I was selling the plate for £xxx" (be realistic on price) and you have 24 hours to pay me this or I will be going to the police with the evidence I have showing you have stolen a plate, that I bought from you, back from me.
