My dad got hit in the back earlier this year. He has a w124 E200. Got given a brand new E220 diesel. Was very nice as it smelt fresh. Unlike his w124 that smells of cigarettes.

No moral high ground, I just think I am entitled to what I have already paid for I.e. A sporty car smile

I don't really complain about insurance prices..... Oddly.

When you renew and you're asked "have you had any incidents in the last 5 years", yes someone hit my car. Ah Sir is now statistically more likely to be in another accident now, that will be an extra £X.

I had a an accident with Admiral (not at fault) in a 330 coupe and they tried to palm me off with a 1.0L corsa, i point blank refused on the phone and stated the hire car needs to be an equivalent, ended up in a brand new A5 Black Edition (2.0TDI) which is a nice place to sit but a woeful drive.

In short you should have asked for a hire car not the garage courtesy car - no offense but you should never of believed what they told you!!!

They have an obligation to keep the cost as low as possible so the hire car was dropped off when I picked my car up, no hassle!

I was given a new E Class last year when my 2005 one was hit from behind - had to wait for the other party to admit liability first, mind.

It was a diesel 4 pot, not a petrol but it was the same size, looked nice and sounded good when it was switched off.

A 9 year old banger for a more modern micra must be an upgrade.

Seems a fair deal to me.

OP was involved in an accident, so he will now be deemed as a higher risk for insurance purposes even though not at fault.

If it keeps insurance costs down then i don't see the problem.

When i crashed my old Honda Accord 2.0 i was given a Hertz Citroen C1.

It was the fastest production car in the world. It was a hire car. I say have some joyous fun in it while you can.

Stuff that - comparable car.

Mate had his 530D hit only worth around £3k and was given an AMG Merc for a month

Why should you suffer because some else made a mistake

Because people take the p*ss, so the law encourages you to minimise costs, rather than treat it as some sort of lottery win.

4.5​Where the vehicle owned is a prestige vehicle the Credit Hire Organisation will make enquiries to ensure the customer has a need for such a vehicle. Where the vehicle is over 6 years old it is the exception, rather than the rule, that a similar prestige replacement is required. Need will then be determined by the make, model, value and use of the vehicle.

GTA Rates & Carptegory Split

For customers with a convertible, unless the model listed is already a convertible, convertibles are treated by placing them into the group higher than the hard top version e.g. BMW M3 is in SP9. The convertible equivalent would be in SP10.

It's not a moral issue whether someone accepts a like for like, since the Court will allow most reasonable like for likes.

Whilst not all credit hire companies are subscribers to the GTA, most are, and since it was implemented it's not the Wild West that it was before and there is not so much adversity, profiteering, or unenforceable credit agreements around as there were.

However... There is certainly some correlation between average settled claim costs and insurance premium rises, but perhaps not as much as you might think. More significant might be how well the insurers investments are doing.

(For what it's worth though, My own opinion is that the Courts should only grant prestige hire in exceptional circumstances, shown with evidence, and anyone else should get a Bog Standard hatchback/saloon/estate/4x4 dependant on the broad category of their own. You can never get a hire car with the exact spec of your own so even as it is at the moment, people have to make compromises every day. but it would be unreasonable to reject a hire car because it didn't have dual climate/Bluetooth/heated seats or whatever. It a risk of being on the road that some tosser ploughs into you - get over it and enjoy tooling around in the rental).

OP - based on your requirements I would have probably insisted in an Insignia at the beginning, which would be perfectly reasonable, but once they'd dicked me around with repairs I would have asked for my full "entitlement" to something like 2 categories lower than the GTA rate for your car (on the basis that your car is over 6 years old).

This also would not have been unreasonable, and might also have encouraged the insurer to kick some butt at the garage to get the car fixed pronto!

When my 3 series was rear ended I was offered a Ford Ka, I didn't complain to them but the next day before I got the Ka they phoned asking if I wanted an A4 instead. The A4 was an S-Line with big alloys, it drove better than the BMW and had a nicer interior, I wanted to keep it.

Reading the topic i get the impression OP just wanted something similar sized rather than similar spec, and the 1.0 stbox micra was just a bit of a poor offering.

Think the main problem was being with the same insurance company, they are effectively taking their money out of their left pocket and putting it in their right, and obviously want to keep costs low whereas if it were a 3rd party they would extract everything they could.

Had my 5 series crunched a few years ago , ended up with a Polo diesel for what ended up being 12 weeks.

Kept me mobile , I even washed it as I would my own car.

Handed it back with nearly 7000 miles extra on it.

Not once did I think I was hard done by , or care less what the neighbours thought.

Life's too short .

A 2005 E55 is worth about as much as a new Micra, I'd say you got a fair deal. What do you want from the insurance co? A gleaming new M5 or E65 AMG? You couldn't afford either so why should your accident mean that you receive a car worth 10x the one you had the crash in? Surely massive risk for the insurance co?
