If it is a scam and finance company come after OP for their £15k,would he be able to rely on the letter saying they cant sue him as their misrepresentation,upon which he acted to his detriment,as a defence to that claim?

This is tedious.

The only person that needs to reply now is the OP.

Web devs... Function request..... Make it so you can lock a thread to all but the OP. Then when they have replied, it becomes open access again.

fk I hate it when someone decides they have had enough of a thread and decide because they have had enough it should be locked down.

Whoa, that is a weird one!

It is quite odd that someone would pay £15k without viewing the car, but at the same time if the seller has a detailed advert and the guy had it HPI checked, then i suppose it is possible if that £15k is not a lot for the buyer?

However, if it is some sort of scam, i don't think the seller (OP) is the one who will get a hit because the money was transferred via chaps and it's all cleared. The finance company has cleared the seller, sent him the letter and perhaps closed his accounts. If something in the future happens, it's between finance company and the buyer. I would suggest the seller to tell the finance company that the new buyer has paid off the finance and not him just so they know.

As for the money and/or the car, i would wait couple of weeks and call him instead of texting. Then if after couple of weeks no reply then re-advertise the car but do keep £15k separate in case he shows up. It could be a serious problem/death so you don't want to be in a hassle of court and police if you spend the money.

Sorry to leave you in suspense. Had too many shandies at the weekend so have been suffering a bit.

I can't even recall where we are up to on this trail however the car is now sold to wbac. only took 15 minutes of their time. Useful to know although after this i don't think i'll be buying and selling private again. Lease is probably the way forward.

Anyhow, car is gone and buyer is asking to have the money transferred across to his bank account. I have a letter from the finance company stating that they have no financial interest in the car and as far as they are concerned the transaction is legit and won't be sending the boys round if it does go tits up later on.

I'm still concerned but as far as i can work out i am covered if it does come back. I'll just have to shrug my shoulders and choose to believe he is legit and is prepared to take a 3.5k hit to get his money back.

I'll update you once all transactions are complete and we can draw a line under this chapter in our lives. There doesn't look like being any Bruce Willis style explosions to conclude this episode. Probably for the best.

this will come back and bite you OP once it all come to the boiling point. Out of interest did you take legal advice? and not just rely on a letter from the finance company?

I love these threads. All sorts of useful advice is given to the OP who then ignores it and crosses their fingers and hopes for the best.

sorry OP, but FFS!

so the buyer can settle 15k finance, but only *then* discover he can't actually afford the extra 7k, so is happy to take a 3.5k loss and end up with no car?? - yeah right.

this whole thing stinks and i think will come back to bite you in time.

i'd be very interested to see a copy of the letter the finance people sent you, that you say states they won't be coming after you if the transaction turns out to be fraudulent.

Maybe the buyer borrowed the money before going bankrupt?

Then after the debt is added to the pile and gets written off, he gets a payment of £12k to another account, which the Receiver's not aware of.
