A torque split is only applicable when there is control over where the torque goes otherwise its just an open diff.

Someone is getting confused, and it isn't me. Have a look at how both the New Venture and Magna Steyr transfer boxes work, they aren't simply open or locked (e.g. the NV limits torque split to 65/35 to either end and can't fully lock).
