If the van really is uninsured your insurance is unlikely to recover any loss from the other party and I very much doubt that the police will give a monkeys.
How is dealing with a third party company by yourself going to be easier than letting Insurance co. (who deal with everything for you) deal with everything?

You pay an insurance premium and that is what they're there for. How will he lose his no claims discount? He has a third party witness, and the driver and company admitting liability early doors. Again, as he is not at fault, he will not lose his excess.

Only bumped up insurance premium I can think of is that he will have to declare a non fault accident when he gets renewals which he would have to do regardless as he has had a non fault accident and he MUST declare it. Just because it never went through insurance co. doesn't mean that he hastn had an accident. Furthermore, that bump up in insurance isn't actually THAT inflated. I think the difference in price between declaring my non fault accident and not was £20 for the full year. I know that's me £20 out of pocket it would seem, but it's not exactly going to mean that I'll have to go for months without food or luxuries.

Nope, but you can buy it back and do it yourself. They won't pay more than the cars worth no matter what. From their point of view you should take the money and buy a new one.

Provide good evidence as to the value of the car pre accident, invoices etc etc. Get some ads for similar age/mileage cars and be prepared not to accept their first offer if it is to be written off.

Unfortunately whether a non fault accident or not the car owner will always lose out.
eg i run a 5.5yr old V50 2ld had since new, fsh etc etc 110000m. Will be worth peanuts(3.5k max) but now owes me nothing and will cost a damn sight more to replace. I keep toying with the idea of changing it but it does everything I need so sensible thing will to be to run it for another 3 yrs 60000m or more then sell it as a cheap shed.

I will just have to wait and see what gets said when it is in for repair.
But it has FSH,timing belt done recentley,new exhaust (was quoted £700+ but mega mates rate discount got it down to less than £400) + £250 spent the week before the bump.
Like you say the innocent driver will always lose out.Piss slowly coming up to the boil.

Perhaps then this experience will help give you a better understanding of Cat C & D.

Your car looks like a wing, bumper an bonnet requiring work, if it ends up written off will you immediately think the car is no longer safe, no longer desirable or accept it's "just" had a bit of paintwork.

On the insurance side though, if the van was not insured you can still deal with it. Do you have fully comprehensive cover ? This is the tricky part, if you only had 3party insurance you'd be eligible to claim from the MIB, sadly if you have fully comprehensive you are expected to claim off your own policy and get stung.

Your insurer then takes it up with the third party which then seems to reinforce the view that insurance can be a joke and it's always the "good guy" that gets shafted!
