Firstly hi, I'm a long time lingerer but first time poster.

Right lets get straight into it.
Tonight I was pulled over on a dual carriageway A road by a marked police car in a hidden layby.
He clocked my speed at 97mph in a 70mph zone.
I have been told to expect a court summons within the next few months but I do not have to attend if I intend to please guilty (which I do) and can respond via post?

Now I know nobody on here can give me legal advice or determine the outcome but has anybody been in a similar position, what was the penalty?
Situation:
9pm at night
Very low traffic
Dry
Lit

The other issue troubling me is the new drivers limit of 6 points in the first 2 years, I have only been driving for a year and a half but had a full bike license for 3 years before that, the police officer informed me that they are considered different and if I got 6 points I would probably loose my license. I didn't agree with this but didn't argue at the time, ive since been on the internet and found this https://www.gov.uk/penalty-points-endorsements/new... which says:
'There isn’t another 2 year period if you pass a test for another category of vehicle, eg to drive a heavy goods vehicle.'

Can anybody please shed some light on this issue, explain how the court process works or in any other way give me some information.

Thanks in advance.

Ouch

its a painful lesson but at least its not a instant ban you may get lucky with just 3 points

what ever happens don't ignore the summands when it arrives

97mph is one mile an hour over the threshold for sending you to court - did they have a radar gun or did they pull that number out of the air?

One of the proper lawyers will be along presently, but if they didn't have any other indication of speed other than their opinion then there's a chance that the speed could be "talked down" in what's known as a Newton hearing.

You've been driving for 18 months and you've been done for 97mph. In my opinion, which probably won't be the opinion of many others on here, is that you deserve a ban of at least six months, preferably a year.

Had similar for the same speed, didn't effect insurance at all noticeably the following year just a bit of a pisser with the fine. Depends on you're personal finances as to how big it'll be too.

First off congratulations for getting stopped. Chances are you will get 3 points, possible ban and a nice fine. All cases differ. Try not to worry about it - cross that bridge when it comes

Trying not to worry about it isn't really an option unfortunately.
I know its my own fault and I am responsible for my actions, but I HATE the uncertainty that I could be looking at loosing my license (If I get 6 points and the office was right regarding the new driver period)

I'd suggest attending court, pleading guilty and saying that you are very, very sorry. If genuinely sorry and able to show it you may not be given the maximum points/fine that the court can give.

Surely that's part of the punishment making you sweat it out whilst you await your punishment. Bet you wish you weren't speeding now wink

You've been caught at 27mph over the limit so I reckon 3 points

I got caught doing 87mph in a 50mph when I was 17 and got 5 points and 300 quid fine and I was 37mph over the limit on a motorway,

I've been told you usually get a ban 30mph over the limit except for special circumstances ie you would lose your job and you have a family to support etc etc so I reckon you will get away with points

Your damn right the uncertainty is the worst part.
In regards to attending court I am very nervous about that and do not think I will be able to get my point across correctly.
I am thinking of pleading guilty via post with a letter explaining how I deeply regret my actions along with some other info from other peoples examples

At least you have a bike license to get about if you can't drive for a while.

Another bonus is the added thrill of getting bummed by insurance companies for the next 5 years.

Aaaaaaahahahahaha. As funny as that is, you should be careful, there's always someone out there willing to take a joke seriously.

You could ask the MODS to move your thread to "Speed,Plod and law"

Your response so far is pretty good but maybe someone in that forum has the answers.

Yeah I'm REALLY not looking forward to my next few insurance renewals!
IF I get to keep my license that is...

Sorry I didn't realize there was a dedicated section for speeding etc. When I say I have been a long term lingerer its only even been in the General Gassing section.

If it's any conciliation, my workmate got caught doing 102 in a 70. No previous points or convictions in 8 years.

He went to court, represented himself, admitted guilt and was extremely apologetic. Hated every single second of it and described it as absolutely nerve wrecking.

He ended up with a 30 day ban, court fees and I think 6 points on his license. (May of been 3) As you'd imagine he was happy with that outcome.

You maybe ok and end up with a similar punishment. Good luck
